Ciao cari Fan di X Factor 9. Oggi ci è arrivata inaspettatamente questa comunicazione da chi gestisce il marchio di “X Factor Italia“: la Fremantle Media. Siamo abbastanza increduli di quanto è successo: infatti il nostro è un blog amatoriale fatto di persone appassionate di questo talent show. Abbiamo già provveduto a chiedere maggiori informazioni al referente di Fremantle Media per cercare di fare chiarezza su questa spiacevole situazione. Nel frattempo abbiamo deciso di oscurare momentaneamente il blog e vi rendiamo partecipi di quanto accaduto riportandovi per intero la comunicazione ricevuta.

My name is Dario Morelli, Esq., and I am the head of business and legal affairs of FremantleMedia Italia S.p.A. (“Fremantle”) which states to be – under penalty of laws against perjury – the producer of the TV show “X Factor” in Italy (“Programme”).

I have been noticed about the existence of a domain name (i.e. www.xfactoritalia.com)(“Website”) infringing Fremantle’s copyright to the trademarks and the content of the Programme.

In particular:

  • the domain name itself, www.xfactoritalia.com, infringes Fremantle’s trademark to the title of the Programme;
  • etc.

The Website as a whole infringes exclusive rights of Fremantle and Sky (i.e. the broadcaster of the Programme) to exploit and distribute the Programme and any relevant trademark and/or image worldwide. Please also note that, under Italian law, such copyright infringement is civil offence and, under certain conditions set forth by Section 171-ter of the law no. 633/1941, might be also a criminal offence punishable with three years of conviction.

Therefore I request that you remove the whole Website immediately, and in any case no later than 8 hours from the receipt of this notification.

In any case, Fremantle reserves the right to request a compensation for damages already caused by you as hosting provider and by the Website owner and, as the case may be, to report any criminal offence allegedly committed against Fremantle.

Please inform me as soon as the infringing content has been removed.
